Terms & Conditions
Full details of our affiliate program terms
- Affiliate: Individual or entity approved to promote the Company's services in exchange for commissions.
- Certification Level: The tier achieved through the Gulani Stores Affiliate Training Program, determining your title and Commission rate.
- Customer: A paying user referred by the Affiliate.
- Commission: Referral fee payable based on Certification Level.
- KYC Information: Know Your Customer documentation required for verification.
- Net Fees: Fees received by the Company from a Referred Customer after taxes, refunds, discounts, and promotional credits.
- Program: The Affiliate Program described herein.
- Services: Company products or services eligible for referral.
Referrals are tracked via your unique link or code. Only new Customers qualify as referrals. Commission rate is fixed for each Referred Customer based on your Certification Level at first purchase.
- Schedule: Monthly, within 30 days after the end of the month.
- Methods: Bank transfer, e-wallet, or approved methods in ZMW or other currencies.
- Minimum Payout: ZMW 500; amounts below roll over to next month.
- Payment Info: Provide accurate payment details; delays from errors are your responsibility.
- Commission Calculation: Based on Net Fees. Refunds, cancellations, or disputes may reduce or reverse commissions.
- Affiliates are responsible for taxes on Commissions under Zambian law.
- Company may withhold taxes if required.
- Affiliates indemnify Company for non-compliance.
- By Company: For breach, inactivity, failure to certify, misconduct, or program discontinuation.
- Effects: Cease promotions, remove materials, stop using certification titles; commissions may be forfeited for cause.
- By Affiliate: Provide written notice; accrued commissions above the payout threshold are paid.
- Survival: Sections covering taxes, IP, confidentiality, liability, and data protection survive termination.
- Limited license to use promotional materials and certification marks during participation.
- License to Company to use your name and certification level for Program promotion.
- Ownership remains with original holder.
Maintain confidentiality of non-public Company information. This obligation lasts five years post-termination.
- No liability for indirect or consequential damages.
- Total liability capped at commissions paid in the prior 12 months.
- Not liable for force majeure events.
- Consent to data collection per Privacy Policy and Zambian law (Data Protection Act, 2021).
- Retention: duration of participation + 7 years.
- Reasonable security measures applied.
- Right to access, correct, delete, or restrict data.
- Governed by Zambian law.
- Disputes resolved first by negotiation; if unresolved, arbitration in Lusaka under Zambia Institute of Arbitrators rules.
- Courts of Zambia have exclusive jurisdiction where arbitration is unenforceable.
- Entire agreement; supersedes prior agreements.
- Severability applies.
- No waiver unless in writing.
- Assignment requires written consent (Company may assign freely).
- Independent contractor relationship; no employment or partnership implied.
- Notices in writing.
- English version prevails.
